OPERATING WHILE INTOXICATED

Iowa Code Section 321J.2 governs the offense of Operating a Motor Vehicle While Intoxicated. If someone is found to be operating a motor vehicle while under the influence of an alcoholic beverage or other drug or a combination of such substances, or operating a vehicle with an alcohol concentration of .08 or more, or has any amount of controlled substance in their body as measured in their blood or urine while operating a motor vehicle, they will be found guilty of the offense of OWI if they either plead guilty or are found guilty by a judge or jury.
